1. About These Terms

These Terms and Conditions govern your use of this website and any purchase you make from Bionobo®. By placing an order, you confirm that you have read, understood and accepted these terms.

Throughout these terms, Bionobo® refers to the brand and online store operated by Follow The Plants OÜ.

2. Definitions

"We", "us" and "our" mean Follow The Plants OÜ, operating Bionobo®.
"Bionobo" means the Bionobo® brand and online store.
"You" and "your" mean the customer or website visitor.
"Products" means the goods offered for sale through the website.
"Order" means your request to purchase Products through the website.

3. Eligibility

You must be at least 18 years old, or the age of majority in your country of residence, to place an order.

By placing an order, you confirm that you meet this requirement and that the information you provide to us is accurate and complete.

4. Products and Information

We take reasonable care to ensure that our Products and their descriptions are presented accurately.

Product images are for illustrative purposes and packaging, appearance or other non-material characteristics may occasionally differ from those shown on the website.

We may update formulations, packaging, product information or availability where necessary.

Many of our Products are food supplements or food products. Food supplements are not medicines and are not intended to diagnose, treat, cure or prevent disease. Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.

Always follow the directions and warnings provided with the individual Product. If you are pregnant, breastfeeding, taking medication or have a medical condition, seek appropriate professional advice before using a food supplement.

5. Prices

Prices are displayed in euros (EUR) unless another currency is expressly displayed.

Prices applicable to EU consumers include VAT where required by law unless clearly stated otherwise.

Any applicable delivery charges are displayed separately during checkout.

We may change our prices at any time. Changes will not affect Orders that have already been accepted.

If a Product is displayed at an obviously incorrect price because of a technical, typographical or other genuine error, we are not required to supply the Product at that incorrect price. Where appropriate, we will contact you and give you the opportunity to proceed at the correct price or cancel the Order.

6. Placing an Order

When you place an Order, you will normally receive an automatic acknowledgement by email confirming that we have received it.

This acknowledgement does not necessarily constitute acceptance of your Order.

A contract for the purchase of the Products is formed when we accept and process the Order for dispatch.

We reserve the right to decline or cancel an Order where reasonably necessary, including where a Product is unavailable, payment cannot be authorised, incorrect information has been provided, or we reasonably suspect fraud or misuse.

If payment has already been collected for an Order that we subsequently cannot accept, the applicable amount will be refunded.

7. Payment

We accept the payment methods displayed at checkout.

Payments are processed through secure third-party payment providers. We do not directly store complete payment-card information.

Your payment provider may apply its own terms, security procedures and authentication requirements.

8. Shipping and Delivery

Orders for customers within the European Union are dispatched from our fulfilment centre in the Netherlands.

We select the carrier we consider most appropriate for each destination based on factors such as location, expected delivery time and service quality.

European Union orders over €140 qualify for free shipping.

International orders outside the European Union over €200 qualify for free shipping, subject to any exclusions or restrictions displayed at checkout.

Shipping charges for Orders below these thresholds are calculated and displayed at checkout.

Delivery times are estimates and may be affected by carrier delays, customs procedures, seasonal demand, weather or circumstances outside our reasonable control.

9. International Orders, Customs and Import Requirements

If you place an Order for delivery outside the European Union, you are responsible for checking with your local customs authority or other relevant authority before ordering to ensure that the Products can legally be imported into your destination country.

International Orders may be subject to import duties, taxes, customs charges or other fees imposed by the destination country. Unless expressly stated otherwise at checkout, these charges are not included in the price paid to us and are the customer's responsibility.

You are responsible for paying any applicable duties, taxes and customs charges.

If an international Order is refused, held, returned or destroyed by customs because:

the Products cannot legally be imported into the destination country;
applicable import requirements have not been satisfied;
the recipient refuses to accept the shipment; or
applicable customs duties, taxes or charges have not been paid,

we will not provide a refund for the Products or shipping charges to the extent permitted by applicable law.

By placing an international Order, you accept responsibility for checking and complying with the import and customs requirements applicable to your destination.

10. Right of Withdrawal and Returns

If you are a consumer in the European Union, you generally have a statutory right to withdraw from a distance purchase within 14 days of receiving the Products, subject to the exceptions provided by applicable consumer law.

Certain sealed Products may be excluded from the right of withdrawal after opening where they fall within an applicable health or hygiene exception.

Nothing in these Terms limits your mandatory rights under applicable consumer law.

11. Cancellations

If you wish to cancel an Order, contact us as soon as possible at hola@bionobo.com.

If your Order has not yet entered the dispatch process, we will try to cancel it.

Once an Order has been dispatched, cancellation may no longer be possible and the applicable return procedure will apply.

12. Intellectual Property

Unless otherwise indicated, the content available through this website, including text, graphics, photographs, product designs, logos, trademarks, videos and the Bionobo® name and brand, is owned by or licensed to us and is protected by applicable intellectual property laws.

You may not reproduce, distribute, commercially exploit or otherwise use our intellectual property without prior written permission except where permitted by law.

13. Acceptable Use

You agree not to use this website unlawfully or in a manner that could damage, disable, interfere with or compromise the website, Bionobo®, Follow The Plants OÜ or other users.

You must not attempt to gain unauthorised access to the website, its systems, customer accounts or associated infrastructure.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

To the fullest extent permitted by law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.

Nothing in these Terms affects your mandatory statutory rights as a consumer.

15. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Our website also uses cookies and similar technologies as described in our Cookie Policy.

These policies should be read together with these Terms.

16. Changes to These Terms

We may update these Terms from time to time, including to reflect changes to our business, Products, website or applicable law.

The Terms applicable to your purchase are generally those in force when you place your Order.

17. Governing Law and Disputes

These Terms and contracts entered into through this website are governed by the laws of Estonia.

If you are a consumer resident in another European Union or European Economic Area country, this choice of law does not deprive you of any mandatory consumer protections provided by the laws applicable in your country of residence.

Where applicable, consumers may also have the right to bring proceedings before the courts competent under applicable EU consumer and jurisdiction rules.
